Abstract: Cindy Cohn, lead attorney in Bernstein v US Dept of State, testified before the Senate Judiciary Committee’s Subcommittee on Constitution, Federalism and Property Rights in 1998 regarding export controls, cryptography, and the First amendment as the Bernstein case progressed. She described the status of the case and other similar challenges pending at the time, and argued why cryptography is protected speech under the First Amendment.
