Abstract: This study from the United Nations Educational, Scientific and Cultural Organization outlines the benefits of encryption to human rights, the legality of interference with free and strong encryption, and gives best practices for nations and other stakeholders. This study offers case studies in various member states, including Germany, the United States, India, and Brazil, and looks at both legal restrictions on encryption as well as legal measures which promote its adoption. The study then goes on to discuss specific impacts encryption policy can have on human rights, including free communication between individuals, transparency of private and government actors, and the role of intermediaries in protecting those they serve. Finally, the study offers recommendations seeking to further human rights protections.
